The petitioner is apprehending his arrest in connection with Beldaur P.S.Case no.217 of 2017 registered for offences punishable under Sections 406, 409, 420, 467, 468, 471/34 of the Indian Penal Code.

Allegation against the petitioner is of defalcation of 'anudan rashi' by putting forged lists.

Submission of the learned counsel for the petitioner is that he is a retired Panchayat Secretary, he is aged about 67 years and the allegation is false against him. He has distributed the amount and rest of the amount has been deposited and he is ready to abide by any condition imposed upon him.

Heard learned A.P.P. also, who has opposed the prayer for

Patna High Court Cr.Misc. No.37624 of 2018 (2) dt.27-08-2018 2/2 bail.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in surrender before the court below within a period of six weeks from the date of receipt of the order and on surrender he will be granted provisional bail till submission of the charge-sheet on the condition that he has to co-operate in the investigation and he shall produce all the papers in the investigation and once the chargesheet is submitted and if the case is found true against him, he shall surrender before the learned court below and make prayer for regular bail, which will be considered on the basis of materials available at that time.
