====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 16-11-2019 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in a case for the offence registered under Sections 302, 201 and 120(B)/34 of the IPC.

The prosecution story, in brief, is that the petitioners alongwith Manoranjan Kumar Singh with the help of other persons killed the son of the informant Akshay Kumar by strangulation and thrown the dead body near Digrahiya Pokhar in order to disappear the dead body.

It has been submitted by learned counsel for the petitioners that the petitioners have got no criminal antecedent.

The petitioners have falsely been implicated in the present case. Except for suspicion, there is no substantive evidence to suggest the implication of the petitioners in the present case. Neither there is any eye witness to the alleged occurrence nor there is circumstantial evidence to suggest the participation of the petitioners in the present case. On behalf of the learned counsel for the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Vaishali, in connection with Tisiauta P.S. Case No. 19/19, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
