2. The petitioner has preferred this application for grant of regular bail in connection with Belsand P.S. Case No. 66 of 2024 dated 12.06.2024 registered for the offences punishable under Sections 25(1-b)(a), 26 and 35 of the Arms Act.

3. As per the prosecution case, one loaded country made pistol was recovered from the possession of the coaccused, Nitish Kumar, one live cartridge was recovered from the possession of the co-accused, Deepak Kumar and one live cartridge was also recovered from the petitioner, Neeraj Kumar.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.60828 of 2024(2) dt.04-09-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. The petitioner has no concern with the alleged recovery. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.06.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Belsand P.S. Case No. 66 of 2024.

7. The application stands allowed.
