The petitioner, who is the husband of opposite party no.2, apprehends his arrest in connection with Complaint Case No. 1670(c) of 2018 for the offence under Sections 494, 498(A) of the Indian Penal Code and 4 of the Dowry Prohibition Act. Learned counsel for the petitioner submits that in terms of Annexure-5, Rs. 40,000/- per month is being deducted from the salary of the petitioner. He further submits that the petitioner is ready to keep his wife with full honour and dignity but the complainant is not willing to stay with her

Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Patna in connection with Complaint Case No. 1670(c) of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

After release the petitioner, the Court below shall refer the matter to the District Mediation Centre. The petitioner and opposite party no.2 will appear before the District Mediation Centre, so that the dispute may be settled amicably between the husband and the wife.

The petitioner shall make payment continuously to opposite party no.2 in terms of order as contained in Annexure-5 for enjoying the privilege of bail.
