The petitioner seeks anticipatory bail in connection with Complainant Case No. 1061(c) of 2017, registered for offences punishable under Sections 323, 341, 386, 504 and 120B of the Indian Penal Code.
As per F.I.R., allegation against the petitioner is of demanding a ransom of Rs. 15,00,000/- from the informant and on refusal, he threatened to face dire consequences and the petitioner along with four or five unknown persons entered in his office and snatched a golden chain worth Rs. 70,000/ and Rs. 38,000/- in cash from his bag.
Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in the present case
Patna High Court Cr.Misc. No.33843 of 2018 (3) dt.30-08-2018 2/2 and entire allegation is false and concocted. It is also submitted that petitioner had never cheated the complainant and both are friends and the matter has been amicably settled between the parties.
Learned A.P.P. and learned counsel for the informant also submitted that the matter has already been settled. Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named on surrender or arrest within six weeks be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-XIV-cum-Additional Chief Judicial Magistrate, Patna in connection with Complainant Case No. 1061(c) of 2017, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court (Vinod Kumar Sinha, J) Sudha/- U T
