====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 01-08-2018 Heard Sri Bijendra Kumar Singh, learned counsel for the petitioner and Sri Madan Kumar, learned Additional Public Prosecutor.
The sole petitioner, apprehending his arrest in connection with Dagaruwa P.S. Case No. 44 of 2018 , registered for the offence under Section 420, 384 of the Indian Penal Code, 1860 , has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner by way of referring to the F.I.R. submits that it is a peculiar case in which though contents of the F.I.R. does not disclose commission of any cognizable offence, to the reasons best known to the Police, the F.I.R. has been lodged.
Besides hearing, I have also perused the materials
Patna High Court Cr.Misc. No.34792 of 2018(3) dt.01-08-2018 2/2 available on record and after going through the same, I am of the opinion that it is a fit case for grant of anticipatory bail. Accordingly, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner - Md. Ishaque @ Esahaque be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Purnea / concerned court in connection with Dagarua P.S. Case No. 44 of 2018 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J) praful/- U T
