This application for grant of anticipatory bail arises out of Madhepura P.S. Case No. 147 of 2016, disclosing offences under Sections 406 and 420 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.
Learned counsel for the petitioners has submitted that even if the allegation made in the First Information Report is treated to be correct, the petitioners were simply connected at the stage of negotiation of marriage and no offence under Sections 3⁄4 of the Dowry Prohibition Act is made out against them. He has also submitted that the allegations do not constitute offence under Sections 406 and 410 of the Indian Penal Code. Petitioners have
no criminal antecedent as stated in paragraph 3 of the application. Considering the above, this application is allowed. Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in Madhepura P.S. Case No. 147 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the police/Court as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
