The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 308, 504, 506 of the Indian Penal Code.
The prosecution case as per F.I.R is that all the accused persons including petitioners, variously armed came at the door of the informant and
Patna High Court CR. MISC. No.68231 of 2021(3) dt.28-06-2022 2/3 assaulted him with lathi, as a result of which, the informant received head injuries.
It is submitted by learned counsel for the petitioners that petitioners have falsely been implicated in this case. There is counter version of the occurrence also and petitioners' side lodged the case at earlier point of time. Moreover, the injuries of the informant have been found to be simple in nature. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.
In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st, Class, Gaya in connection with Delha P.S. Case No. 232 of 2020, subject to the
Patna High Court CR. MISC. No.68231 of 2021(3) dt.28-06-2022 3/3 conditions as laid down under Section 438(2) of the Cr.P.C.
