The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 406 of the Indian Penal Code and Section 66 (D) of the I.T. Act.

Some unknown person telephoned to the informant that he is Manager of a Bank and called bank details of the account of the informant, thereafter withdrew Rs.27,290/- from the account of the informant. The mobile number which was used for getting the bank details was issued in the name of the petitioner.

The case diary would reveal that the said unknown

Patna High Court Cr.Misc. No.20674 of 2017 (3) dt.01-07-2017 2/3 person has already deposited Rs.16,000/- and odd in the said bank account.

Submission of the learned counsel for the petitioner is that the case diary would reveal that there is no material to substantiate that who had purchased the said SIM card in the name of the petitioner nor it has come on the record that identity proof of the petitioner was used for purchase of the said SIM card, therefore, the seller of the SIM card was also responsible and the investigation has not conducted properly. The petitioner is ready to cooperate with the investigation and trial. Considering the fact that there is no substantial material collected against the petitioner during investigation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.

20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri, District Rohtas/successor Court in connection with Dehri (Dalmiya Nagar) Police Station Case No.

Patna High Court Cr.Misc. No.20674 of 2017 (3) dt.01-07-2017 3/3 which the court below shall be at liberty to cancel the bail bond of the petitioner.
