The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,324,325,307 and 504/34 of the Indian Penal Code. The prosecution case is that the co accused persons assaulted the informant with lathi and iron rod whereas the petitioner assaulted the informant with butt of pistol. It is submitted by the learned counsel for the petitioner that one injury has been found to be grievous but the accusation has been levelled in the background of land dispute as the informant and the petitioner are heirs of common ancestors and the

Patna High Court Cr.Misc. No.34451 of 2015 (2) dt.17-08-2015 2/2 case lodged by the petitioner is at earlier in point of time. Learned counsel for the informant submits that the case lodged by the petitioner has been found to be false. Considering the nature of accusation, the manner of causing injury and Statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Begusarai Mufassil P.S. Case No. 176 of 2015 pending in the court of learned CJM, Begusarai. This application is disposed of with the aforesaid observation/direction.
