Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. The FIR was lodged against unknown criminals with allegation that they have snatched motorcycle of the informant.
Submission of the petitioner is that the petitioner is in custody since 28.07.2016 thereafter no TI Parade was conducted in respect of the petitioner. The petitioner has got no criminal antecedent. Nothing was recovered from the possession of the petitioner. Similarly situated co-accused Rakesh Kumar Yadav has already been allowed bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 42510 of 2016 on 06.10.2016. Considering the aforesaid facts, let the petitioner,
Patna High Court Cr.Misc. No.42407 of 2016 (3) dt.13-12-2016 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan/Successor Court in connection with G.B. Nagar (Tarwara) P.S. Case No. 156 of 2016.
