JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 246 of 2018, disclosing offences under Section 498A of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.
Case is under Section 498-A of IPC with respect to demand of dowry and torture and further allegation that he has married with another lady. It appears that the process has been issued only for the offence under Section 498A IPC. Submission of learned counsel for the petitioner is that as a matter of fact, she has solemnized marriage with another person, which has given in the informatory petition, but
Patna High Court CR. MISC. No.55572 of 2019(4) dt.21-11-2019 2/2 no details address of the person with whom she has married is given in the informatory petition. Further submission is that he is still ready to keep her with dignity and care, if she is ready to live with him.

In such view of the matter, let the petitioner, above named, surrender on 09.12.2019 and on that day, the opposite party no.2 shall also remain present in the Court. Further on filing of the affidavit by the petitioner that he is ready to keep her with full dignity and care, the learned court below shall release the petitioner on provisional bail for a period of six months. During that period, the learned court below shall watch the conduct and marital relationship of both the parties. Once the court below is satisfied with the conduct of both the parties, the court below either confirm the bail bonds of the petitioner or pass any other orders which may deem fit and proper, including cancelling the bail bonds of the petitioner.
With the aforesaid observations, this application is disposed of.
