The petitioner seeks bail in connection with Kowakole (Rupao) P.S. Case No.19 of 2008 registered under Sections 147, 148, 149, 323, 337, 307, 353 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted that in course of investigation the police did not find the complicity of the petitioner in the present case. The police had submitted charge-sheet only for the offences punishable under Sections 147, 323 and 337 of the Indian Penal Code against unknown accused persons. However, differing with the police report, the learned Chief Judicial Magistrate, Nawada took cognizance of the offence punishable under Section 307/34 of the Indian Penal Code also and

Patna High Court CR. MISC. No.74594 of 2019(2) dt.11-12-2019 2/2 summoned the petitioner apart from others. It is further contended that the petitioner is in custody since 04.06.2019. Regard being had to the submissions made above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Kowakole (Rupao) P.S. Case No.19 of 2008.
