2. The petitioners have preferred this application for grant of regular bail in connection with Adapur P.S. Case No. 344/2022 dated 03.12.2022 registered for the offences punishable u/ss 341, 323, 354B, 313, 504 read with section 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioners and the co-accused persons are alleged to have started abusing the informant by saying her witch. The petitioner no. 2 Sanjay Singh is alleged to have dragged her on the floor by pulling her hair due to which she became disrobed. In the meantime, the

No.56562 of 2025(2) dt.27-08-2025 2/3 petitioner no. 1 Ajay Singh caught hold of her both hands and other accused caught hold of her both legs and the petitioner no. 2 Sanjay Singh assaulted her with the butt of fire-arm on her stomach causing miscarriage and she became unconscious.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case due to land dispute. The informant is the wife of younger brother of the petitioners. As per the injury report, the injury is stated to be simple in nature. The allegation against the petitioner no. 1 is of only catching hold of her hand. The petitioner no. 1 has five criminal antecedents and the petitioner no. 2 has six criminal antecedents as stated in para 3 of the bail petition. The petitioners are in custody since 26.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Motihari, East Champaran in

Patna High Court CR. MISC. No.56562 of 2025(2) dt.27-08-2025 3/3 connection with Adapur P.S. Case No. 344/2022, with following condition/s:- (i). The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to cancelled.
