This application for anticipatory bail arises out of Dehri P.S. Case N0. 804 of 2018, disclosing offences under Sections 147,332,333,295,353,504 of the Indian Penal Code and Section 3/4 of the Loudspeaker Act, 1955. Learned counsel appearing on behalf of the petitioner has drawn my attention to an order of this Court dated 09.04.2019 passed in Cr. Misc. No. 22571 of 2019, whereby similarly circumstanced co-accused persons have been allowed anticipatory bail.

I find force in the submission made on behalf of the petitioner that his case is on similar footing those who have been allowed anticipatory bail.

Considering the above submission, this application is allowed.

Patna High Court CR. MISC. No.55798 of 2019(2) dt.04-09-2019 2/2 Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Dehri in Dehri (T) P.S. Case No. 804 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled. The observation made in the order dated 09.04.

2019 to the effect that if the petitioners are found indulging in such activities in future, their bail bonds shall be liable to be cancelled on an application made by the prosecution shall apply in the case of the petitioner also.
