The petitioner seeks bail in a case registered for the offences punishable under Sections 384 and 386 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 01.06.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that he received an extortion call from mobile no. 8678009162 on his mobile and the caller demanded extortion of Rs. 5 lakhs, accordingly the F.I.R was instituted.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.68799 of 2021(2) dt.21-04-2022 2/2 petitioner is innocent and has been falsely implicated in the present case based on his antecedents. It is further submitted that the mobile number from which extortion call came does not belong to the petitioner. Learned counsel submits that petitioner was arrested in Chhatauni P.S. Case No. 222 of 2021 and was made to confess about his participation in the present crime. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 01.06.2021, charge-sheet has been submitted in the case and his name came based on his own confessional statement, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Motihari Town P.S. Case No. 361 of 2021 with a condition that one of the bailors of the petitioner shall be his father, Devanand Ram.
