Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that six accused persons surrounded the brother-in-law of the informant when Ganesh Pandey and Manoj Kumar made indiscriminate firing on the brother-in-law of the informant who succumbed to the injuries. The name of the petitioner sprang up during investigation when from the call details of mobile of the victim, it transpired that petitioner was also present around the place of occurrence.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.34769 of 2015 (2) dt.18-08-2015 2/2 informant that subsequently the wife of the victim and other witnesses have suggested the name of the petitioner as the main king-pin.

Considering the fact that there is specific accusation in the First Information Report against Ganesh Pandey and Manoj Kumar and petitioner was not named in the First Information Report, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Samastipur in connection with Samastipur Muffasil P.S. Case No. 62 of 2015, G.R. No. 461 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
