JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-07-2017 Heard learned counsel for the petitioners. No one appears on behalf of the State to assist the court. The petitioners are apprehending arrest in connection with Vijayeepur P.S. Case No. 179 of 2016 for the offence under sections 341, 323, 447, 448, 354(A), 354(B), 379, 504 and 506/34 of the Indian Penal Code.
From perusal of the FIR, it appears that allegation against the petitioners and others are outraging modesty of the informant. The explanation of delay in lodging of FIR is that after the occurrence, she was busy in her personal work and therefore, she has lodged the FIR belatedly which does not appear to be a genuine reason particularly in view of the fact there was
Patna High Court Cr.Misc. No.31312 of 2017 (2) dt.13-07-2017 2/2 Gramkachari Case No. 02 of 2016 filed by the petitioner no.1 dated 8.11.2016 with regard to cutting and theft of the standing Seesam tree on 07.11.2015.
Having regard to the facts and circumstances as mentioned above and considering the fact that petitioners have stated in paragraph-3 that they have clean antecedent, let the petitioners, named above, be released on bail in the event of surrender or arrest before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM-IV, Gopalganj or successor court, in connection with Vijayeepur P.S. Case No. 179 of 2016 subject to the condition as laid down under section 438(2) of the Cr.P.C. (Anil Kumar Upadhyay, J) Ravi/- U T
