The petitioner apprehends his arrest in a case under Section 366(A) of the Indian Penal Code.
The informant alleged that her minor daughter was missing and he suspected that the petitioner and others have kidnapped her minor daughter but the victim appeared and made her statement under Section 164 of the Code of Criminal Procedure and disclosed that she voluntarily went along with the petitioner and, on request of the petitioner, she solemnized marriage with the petitioner in a temple. She further disclosed that the petitioner took her to Delhi but did not establish physical relation with her. The victim disclosed her age to be about 151⁄2 years. She also disclosed that she was having love affairs with the petitioner for last two years.

No.35379 of 2015 (3) dt.30-10-2015 2/2 Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in Amarpur P.S.
