Petitioner apprehends his arrest in Mahua P.S. Case No.212 of 2017 instituted for the offence under Section(s) 302,201 and 380/34 of the Indian Penal Code.
In the written report, it is alleged that widow sister of the informant was assaulted mercilessly by the petitioner and his family members. As a result of which, she died and they got her dead body disappeared.
Case diary has been received.
Learned APP, after perusing the case diary, has submitted that witnesses at different paragraphs of the case diary have fully supported the case taking the name of this petitioner. It has further been submitted that in the supervision note it has been mentioned in detail that there was some land in the name of the deceased and
Patna High Court Cr.Misc. No.37974 of 2018(3) dt.02-08-2018 2/2 just to take possession of those land this petitioner and his family members have committed the murder of the deceased and her dead body has been made to disappear.
Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by the present order.
