No.7453/2016 has been filed on behalf of heirs

Patna High Court MJC No.2219 of 2010 (13) dt.21-09-2016 of respondent no.11 who once upon a time was one of the plaintiff and further, the substitution relating to him on account of his death so made under I.A. No.2032/2016 was dismissed on account of delay.

Considering the submission having made on behalf of petitioners, subject to cost of rupees one thousand, the same is allowed. Cost should be deposited in High Court Legal Services Committee within fortnight and receipt should be tagged with the instant petition, failing which the order will cease to survive. Considering the submission having made on behalf of petitioners, within a week the peremptory order dated 08.01.2010 passed in F.A. No.769/1995 is going to be complied with. That being so, with the aforesaid condition F.A. No.769/1995 is directed to revive. In case the requisites are not deposited within a week then in that event the F.A. No.769/1995 will have to meet with same sequence.

With the aforesaid condition MJC No.2219/2010 is allowed.
