2. Petitioner seeks regular bail in connection with Sessions Trial No. 675 of 2025 arising out of Harpur P.S. Case No. 19 of 2025 dated 03.02.2025 registered for the offences punishable under Sections 103(1) and 238 of the Bharatiya Nyaya Sanhita.

The main submissions advanced by the petitioner's counsel are that the petitioner is a lady and the mother of the deceased child, and as per the allegation, the petitioner's daughter was unwell at the time of the alleged offence and on account of some disturbance and family reason, the petitioner allegedly threw her minor daughter into a pond, resulting in her

It is further submitted that the petitioner belongs to a poor family and had no intention to kill her daughter and she has been languishing in jail since 04.02.2025. It is lastly submitted that there are three surviving children of the petitioner who need her care, as the petitioner's husband is in Nepal for the purpose of his livelihood.

4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

5. Heard both sides and perused the FIR and the trial court's order. Though there is a serious allegation against the petitioner relating to the heinous offence of the murder of her own daughter, aged about one and a half months, however, considering the circumstances under which the alleged offence of murder took place as appears from the FIR, the petitioner's background, her three minor children, and also the fact that the petitioner's husband is in Nepal for the purpose of his livelihood, coupled with the petitioner's custody period and completion of investigation against her, in my opinion, the petitioner deserves a lenient approach from this Court. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the
