The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 506, 302 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 23.08.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the informant alleges that on account of land dispute, there was a fight between the parties in which against this petitioner it is alleged that he assaulted the daughter-in-law of the informant by an iron rod on stomach and took away her gold chain while other accused also assaulted other inmates of the house.

No.68326 of 2021(2) dt.20-04-2022 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and even presuming what has been alleged is true, then the injury of the victim is simple in nature and the co-accused Bharat Chaudhary has been granted bail vide order dated 26.06.2019 passed in Cr. Misc. No. 39154 of 2019 and co-accused Prahlad Chaudhary has also been granted bail vide order dated 28.06.2019 passed in Cr. Misc. No. 39824 of 2019. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent, charge-sheet has been submitted in the case, the injury of the victim is simple in nature and the co-accused have been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Dinara P.S. Case No. 345 of 2018.
