2. Petitioner seeks regular bail in connection with Pirbahore P.S. Case No. 335 of 2025 dated 26.04.2025, registered for the offences punishable under Sections 126(2), 115(2), 125, 329(3), 303(2), 324(4), 324(5), 329(4) & 3(5) of the Bharatiya Nyaya Sanhita and Sections 3 & 4 of the Explosive Substances Act.

The main submissions advanced by the petitioner's counsel are that there are two parts to the alleged occurrence: the first took place on 25.04.2025 during the feast (Bhandara), in which, including the petitioner, three individuals were named and eight were shown as unknown and the second part of the

No.56657 of 2025(2) dt.19-08-2025 2/3 occurrence is said to have taken place on 26.04.2025, on that day, the petitioner was under treatment at P.M.C.H., Patna, and in this regard, Annexure P/2 is relevant and in fact, on 25.04.2025, during the course of the feast, a marpit (physical altercation) took place in between two groups of the students; however, that matter was settled amicably. It is further submitted that the petitioner has been wrongly shown as being involved in the occurrence which is said to have taken place on 26.04.2025, with malafide intentions by the prosecution. It is also submitted that the petitioner is a nineteen-year-old student currently pursuing a Mass Communication course at Patna College, Patna, and he has been languishing in jail since 20.06.

2025 and his entire educational career will be ruined if he is kept behind bars continuously. It is lastly submitted that, although there are criminal antecedents of three cases against the petitioner but he is already on bail in two of them, and in the third case, his bail petition is pending.

4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

5. Considering the aforesaid submissions and mainly the petitioner's young age as well as his defence that he was under treatment at P.M.C.H., Patna, during the course of the

No.56657 of 2025(2) dt.19-08-2025 3/3 alleged occurrence which is said to have taken place on 26.05.2024 and also taking into account the petitioner's academic career, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Pirbahore P.S. Case No. 335 of 2025 on the following conditions:- (i) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the trial Court and shall remain physically present as and when directed by the trial Court and failing which, in case of his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the trial Court.

(ii) If the petitioner tampers with the evidence or influences the witnesses, in that case, the prosecution will be at liberty to move for cancellation of his bail. (iii) One of the bailors shall be a close relative of the petitioner who has sworn affidavit in this miscellaneous petition. (Shailendra Singh, J) maynaz/- U T
