JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 304B and 120B/34 of the Indian Penal Code Section 4 of the Dowry Prohibition Act. The accusation is of killing the daughter of the complainant after five years of the marriage for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioner that the marriage between the petitioner and daughter of the complainant on 28.06.2008 is admitted. The victim died on 01.12.2013 when U.D. Case No. 05 of 2013 was filed stating therein that the victim committed suicide, thereafter the present

Patna High Court Cr.Misc. No.37048 of 2015 (2) dt.28-08-2015 2/2 complaint was filed on 06.12.2013.

Considering the fact that the victim died unnatural death within five years of marriage, let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Complaint Case No. 1153C of 2013 pending in the court of learned SDJM, Hilsa, Nalanda.

Accordingly, the application is disposed of.
