JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 06-11-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in a case instituted for the offence under Sections 447, 307, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per allegation in the FIR, some miscreants including the petitioner came to the shop of the informant and assaulted him for which he had given an application to the police station. Now out of the same miscreants, two accused persons including the petitioner fired upon his son, namely, Ram Naresh Yadav thrice as a result of which he received fire injury and fell down. On gathering of local people, accused persons fled away after giving him threatening.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.59769 of 2023(3) dt.06-11-2023 2/2 that petitioner has been falsely implicated in this case. As per injury report, no any scar mark, no bruise and no any lacerated wound found over the body of the informant. Petitioner is languishing in judicial custody since 27.3.2023. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial magistrate 1st Class, Jhanjharpur, Madhubani in connection with Laukahi P.S. Case No. 24 of 2023.
