Heard Mr.Anish Chandra Sinha, learned counsel appearing for the opposite party.
The learned counsel appearing for the opposite party has submitted that the Miscellaneous Case No.18/2011 has already been disposed of by order dated 28.11.2016 and the application (C.W.J.C. No.2799/2013) was filed against the order dated 27.04.2012 passed in the said Miscellaneous Case No.18/2011. It has, therefore, been contended that now the present restoration petition has become infructuous. The learned counsel for the petitioner has not disputed the fact that the Miscellaneous Case No.18/2011 has now been disposed of.
Patna High Court MJC No.3355 of 2016 (5) dt.08-03-2017 In view of the aforesaid fact, this restoration application is dismissed as infructuous.
