JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Kumarkhand P.S. Case No.; 99 of 2013 registered for the offence punishable under sections 366A/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the victim in her statement under section 164 Cr.P.C. (Annexure-2) has stated about her love affair with this pettiioner and she has further stated that she went voluntarily and married this petitioner. Out of the wedlock, two children were born. Medical Board has assessed her age to be 22-25 years i.e. major. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the

No.31269 of 2017(3) dt.20-09-2017 2/2 petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No. 99 of 2013 subject to the conditions laid down under section 438(2) Cr.P.C.
