The petitioner apprehends his arrest in connection with Paroo P.S. Case No. 57 of 2016 registered under Section 414/34 of the Indian Penal Code.
The accusation is that on receiving secrete information about keeping theft motorcycle in the house of the petitioner, the Police reached there and on search, he recovered one motorcycle bearing Registration No. BR 05 4199 from the hut situated adjacent to semi constructed house of petitioner and another motorcycle was also recovered to hut situated near the house of Rajendra Thakur and it was informed that Chandan Thakur, S/o Rajendra Thakur and Chandan Kumar fled away on seeing the Police.
Patna High Court Cr.Misc. No.44546 of 2016 (2) dt.27-10-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the alleged theft motorcycle was not recovered from the semi constructed house or house of the petitioner, rather the same was recovered from the hut situated near the semi constructed house of petitioner. Further submission is that petitioner has no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M., 1st Class, Muzaffarpur in connection with Paroo P.S. Case No. 57 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
