JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 341, 324, 307, 498A, 120B, 494, 34 of the Indian Penal Code.

The accusation is of torture, making assault and performing second marriage.

Learned counsel for the petitioner submits that the petitioner denies the factum of marriage. The informant has lodged altogether six cases against the petitioner out of which the petitioner is granted anticipatory bail in Dehri P.S. Case No.266 of 2010 on 28.05.2015, filed levelling accusation under section 498A of the Indian Penal Code wherein the petitioner has been directed to pay Rs.750/- per month to the informant -

Patna High Court Cr.Misc. No.35383 of 2015 (2) dt.18-08-2015 2/2 opposite party no.2. Consequently, the petitioner is making the payment. It is further submitted that Shastrinagar P.S. Case No.717 of 2014, Nasriganj P.S. Case No.168 of 2014, Gandhi Maidan P.S. Case No.473 of 2014, all filed with similar accusation under sections 498A, 341 and 307 of the Indian Penal Code within a month which shows the malicious nature of accusation being levelled by the informant.

Considering the fact that in other case lodged with accusation under section 498A of the Indian Penal Code, the petitioner has been granted anticipatory bail and directed to make payment of Rs.750/- to the informant, let the above named petitioner be released on anticipatory bail for one year in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Nasriganj P.S. Case No.168 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
