JUSTICE ARUN KUMAR ORAL ORDER 10-07-2017 Heard learned counsel for the petitioners and the learned APP appearing on behalf of the State. Petitioners apprehend their arrest in connection with Rosera P.S. Case No.106 of 2017 registered under Sections 341, 323, 324, 307, 354, 379, 504 and 506/34 of the Indian Penal Code. Allegation is that accused Amit Sah tried to hit informant's daughter by tractor and these two petitioners came thereafter and started assaulting the labourers engaged in construction of house of the informant. The cause for committing the occurrence is said to be the land dispute. Learned counsel for the petitioners submits that there is no allegation of assault by these petitioners to the daughter of the informant, only allegation is that they assaulted one Md.

No.30750 of 2017 (2) dt.10-07-2017 2 / 2 Sukman, labourer, causing injury in his hand that too simple in nature and due to land dispute these two petitioners have falsely been implicated and they have got no criminal antecedent. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Samastipur in connection with Rosera P.S. Case No.106 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
