Petitioners apprehend their arrest in connection with a case registered under Sections 147, 148, 149, 447, 506, 323, 324, 307, 379 of the Indian Penal Code.
Allegation in brief is that the petitioners assaulted the informant's side causing injury on the head of the injured side. It is submitted that there is no specific allegation of assault against these three petitioners rather specific allegation of assault is against another co-accused Ashraf Ansari and Mazhar and there is case and counter case between both sides. Patna High Court Cr.Misc. No.30536 of 2017 (2) dt.10-07-2017 2/2 relates to the passage leading to their houses and one of the petitioner is lady and they have no criminal antecedent. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Arif Ansari, Aslam Ansari and Samira Khatoon be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Siarhana at Dhaka, East Champaran, Motihari in connection with Trial No.4171 of 2016 arising out of Dhaka P.S. Case No.44 of 2016, G.R. No.151 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
