The petitioner apprehends his arrest in connection with Mansi P.S. Case No. 45 of 2016 registered under Sections 25(1-AA)26(1)/35 of the Arms Act.
The allegation is that on receiving secret information about preparing the illegal fire arms at the bank of Kosi river near Dhanchhar High School by this petitioner, the Police reached there and recovered parts of fire arms and instruments, which are used in preparing the fire arms. One person was apprehended there, who disclosed his name Md, Giddo and he also disclosed names engaged by the petitioner for preparing the country made fire arms.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.43750 of 2016 (2) dt.17-10-2016 2/2 petitioner submits that in fact, petitioner has not been apprehended on the spot rather his name has been disclosed by Md. Giddo, who was apprehended by the Police. Further submission is that nothing has been recovered from the possession of this petitioner and he has no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the District and Sessions Judge, Khagaria in Sessions Trial No. 211 of 2016 arising out of Mansi P.S. Case No. 45 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
