The petitioners seek bail in connection with Ganga Birdge P. S. Case No.119 of 2021, instituted for the offences under Sections 30(a), 36, 41(1) of the Excise Act, 2018 and Sections 420, 467, 468, 471 and 120(B) of the I.P.C. The learned counsel for the petitioners submits that the petitioners are in custody since 04.06.2021, they are persons with clean antecedents and charge-sheet has been submitted in the case.

Allegation is of recovery of 3872.520 litre of liquor from a truck as detailed in the F.I.R.

Patna High Court CR. MISC. No.68336 of 2021(2) dt.18-02-2022 2/2 The learned counsel for the petitioners submits that petitioners are the driver and the cleaner of the truck and as such, were not aware what the owner and transporter had loaded in the truck.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedents and chargesheet has been submitted in the case, the petitioners, abovenamed, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Excise Court, Vaishali at Hajipur in connection with Ganga Birdge P. S. Case No.119 of 2021.

The application stands allowed.
