Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Lalganj P.S. Case No. 233 of 2021 lodged under Sections 304(B)/34 of the I.P.C.

As per the prosecution case, F.I.R. has been lodged against 4 named accused persons, including the present petitioner and the allegation of continuous assault of the deceased is there in the F.I.R. against the present petitioner and his entire family. Allegation of killing and concealment of the dead-body of deased is there in the F.I.R.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.62766 of 2022(2) dt.22-02-2023 2/2 petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 28.01.2022 having clean antecedent and charge has already been framed in this case.

Learned counsel for the State opposes the prayer for bail and submits that petitioner is the husband of deceased and this is a case under Section 304(B)/34 of the I.P.C. In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner.

With this observation, the bail application stands rejected.

Trial court is directed to expedite the trial and conclude it within six months from today.
