JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2018 The petitioner is apprehending his arrest in connection with Marhowrah P.S. Case No. 382/16, registered for offences punishable under Sections 304B/34 of the Indian Penal Code. Petitioner happens to be the husband of deceased and allegation against him is of causing dowry death of the deceased. Submission of learned counsel for the petitioner that in fact the deceased had committed suicide and petitioner has falsely been made accused in this case and he was not present on the day of occurrence.

Learned counsel for the State opposed the prayer for bail on the ground that the deceased died within one and half years of her marriage and that too under abnormal circumstances. Having heard both sides, considering the facts and

No.39960 of 2018 (4) dt.13-09-2018 2/2 circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail, which will be considered on merit of the case.
