The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code. The prosecution case is that the informant made protest for throwing garbage in front of his shop, when on the order of Mahesh Choudhary this petitioner assaulted with iron rod on the head of the informant. When son of informant came to rescue, the accused persons also assaulted him. The petitioner snatched gold chain and Mahesh Choudhary snatched ring and cash Rs. 30,000/-. It is submitted by the learned counsel for the petitioner that for a petty dispute the accusation has been levelled. The injury has been found to be simple in nature.
Patna High Court Cr.Misc. No.38701 of 2015 (2) dt.29-09-2015 There is counter version of the occurrence. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 184 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
