JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-08-2019 Learned counsel for the petitioners seeks permission to withdraw the present petition on behalf of the petitioner No.3 Babulal Marandi submitting that the aforesaid petitioner has been arrested during the pendency of this case. Permission is granted.
Accordingly, the present petition arising out of Raniganj P.S. Case No. 82 of 2019 is hereby dismissed as withdrawn against the petitioner No.3.
Petitioners No. 1 and 2 seek bail in anticipation of their arrest in connection with Raniganj P.S. Case No. 82 of 2019, registered for the offences punishable under Sections 341, 323, 354 (B), 379, 427, 504, 506/34 of the Indian Penal Code. Allegation against petitioner No. 1 is that he assaulted
Patna High Court CR. MISC. No.54596 of 2019(2) dt.30-08-2019 2/2 the informant by fist and slap and allegation against petitioner No.2 is snatching silver chain from the neck of the informant. Submission of the learned counsel for the petitioners is that there is land dispute between the parties which will appear from Annexures 2 and 3 of the petition. Moreover, specific allegation of assault and outrage of modesty was against petitioner No. 3.

In view of the above facts and circumstances, let petitioners No. 1 and 2, above named in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Raniganj P.S. Case No. 82 of 2019, subject to the condition as laid down under Section 438
(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
