JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307, 385, 120B/34 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, on 03.02.2015 while the informant was returning home from Tekari and reached near the land of Padum Singh this petitioner along with one another accused persons fired as a result of which the informant sustained injuries.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case due to old enmity and on account of land dispute. Petitioner is in custody since 15.04.2019 and investigation in this case is complete.

Patna High Court CR. MISC. No.68455 of 2021(4) dt.25-04-2022 2/2 Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner has got criminal antecedent and 12 cases of heinous and serious offence are pending against him.

Considering the nature of accusation, gravity of the offence and criminal antecedent of the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

However, since the petitioner is in custody since 15.04.2019, the trial court is directed to conclude the trial as early as possible.
