The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 379, 353/34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Learned counsel for the petitioners is permitted to make necessary correction in the petition.

It is alleged that while the informant being headmaster of Primary School of Ilatola sitting in his official room the accused persons came and abused him by calling caste name. The accused persons also took away official documents, records of the

Patna High Court Cr.Misc. No.35225 of 2015 (2) dt.20-08-2015 2/2 school and threatened the informant to withdraw the complaint lodged against petitioner no.1, at earlier point of time. It is submitted by learned counsel for the petitioners that petitioner no.1 was given charge of the headmaster of the school but the same was not being handed over by the informant and petitioner no.1 was humiliated and assaulted for which Bakhtiarpur P.S. Case No.83 of 2015 was lodged against the present informant. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the case lodged by the petitioners' side at earlier point of time, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No.85 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
