This application is filed for directing the learned S.D.J.M., Katihar to dispose off the vide Complaint (Domestic Violence Act) Case No. 519 of 2017 (Tilotma Kumari Vs. Umashankar) which is pending since 2017.

As per prosecution case, marriage was solemnized between the parties on 11.12.1999 at the house of the petitioner according to customs and rituals of the Hindu Society. The father of the petitioner had given Rs. Ten lacs including

Patna High Court CR. WJC No.1302 of 2019(4) dt.06-04-2023 2/2 motorcycle, Palang, T.V. Freeze utensils clothes etc. along with the ornaments. The petitioner went to her matrimonial home along with the articles given to her. A female child was born out of the wedlock of the parties who is about 12 years old and is known as Chahat Kumari @ Bindi. After birth of female child the respondent and his parents stated teasing and quipping the petitioner for the delivery of female child. The respondent and his parents viz Chandra Kishor Das and Lila Devi stated subjecting the petitioner to cruelty in different manner to fulfill the illegal demand of Rs. Twenty Lacs as dowry. Due to nonfulfillment of wrongful demand the respondent and his parents ousted the petitioner along with her minor daughter.

Petitioner has lodged a case against the respondent and his parents in Complaint (Domestic Violence Act) Case No. 519 of 2017. The Sub Divisional Judicial Magistrate, Katihar is directed to conclude the trial within one year. Accordingly, this application is disposed of.
