JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings.. The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 323, 504, 506, 307 and 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case and the allegation is of assaulting the father of the informant by Sheo Narayan Bind by iron rami on his head, when his father had intervened to settle the dispute which has arisen between the children while playing and when the informant went to save his father, he was also assaulted by the named accused persons. Learned counsel for the petitioner further submits that

No.69206 of 2021(2) dt.22-04-2022 2/2 specific allegation of assault is against Sheo Narayan Bind and against this petitioner, the allegations are general and omnibus in nature. Further, similarly situated co-accused have been granted bail by Annexure 3 series and Vijay Bind has been granted bail by order dated 25.01.2022 in Cr. Misc. no. 48963 of 2021.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case and there is no specific allegation of assault against him and co-accused have been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Shivsagar P.S.
