JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147/148/149/341/323/307/354/379/435/337/427/504 of the Indian Penal Code.

The prosecution case is that the mob were chasing a girl when the girl took shelter in the shop of the informant then she was saved on arrival of the police. It is alleged that many articles of the medicine shop of the informant were destroyed when wife of the informant came to rescue her clothes were torn by coaccused Karua Paswan. The accused persons took away Rs.20,000/- from the medicine shop of the informant and robbed medicines worth Rs.50,000/-. The accused persons also damaged the police jeep and set on fire the Scooty of the informant.

Patna High Court Cr.Misc. No.36278 of 2015 (2) dt.09-09-2015 2/2 It is submitted by learned counsel for the petitioner that for the same incidence Bidupur P.S. Case No.279 of 2014 was registered by the police against the petitioner and others wherein the petitioner has been granted anticipatory bail by the learned court below, a statement to that effect has been made in paragraph 3 of the petition. For the same occurrence, the present case was registered by the informant Shashi Kumar Singh. It is further submitted that co-accused Nanku Paswan and others have been granted anticipatory bail by a co-ordinate bench of this court vide Criminal Miscellaneous No.23267 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No.280 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
