The petitioner apprehends his arrest in Jamalpur P.S. Case No. 165/2014, registered for the offences punishable under Sections 120B, 420, 406, 467 and 468 of the Indian Penal Code. The informant filed complaint case on the basis of which the present F.I.R. was lodged. The informant alleged that he was appointed as Chief Executive in Waris Finance International Ltd. and also started working as Agent of the company. The informant alleged that he used to deposit money of his own and other customers and obtained receipts for it from the Accused no. 9 the petitioner, 11 and 12, the Cashier issued receipts of the money.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.15944 of 2017 (3) dt.03-07-2017 2/2 petitioner is one of the Cashiers. The petitioner did not defalcate any money. After receiving the money he issued receipts and the entire money was taken by the Directors of the Company. The petitioner resigned from the post of Cashier in the year 2013 when the salary of the petitioner was stopped.

Considering the facts aforesaid and the fact that informant was agent in the Company and the petitioner was working, as the Cashier and there is no material on record to show that the petitioner defalcated any money or committed breach of trust, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IInd, Munger in connection with Jamalpur P.S. Case No. 165/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
