The petitioner apprehends his arrest in connection with Excise P.S. Case No. 04 of 2016 registered under Sections 47(a) and 9 (d) of the Excise Act.
The accusation is of recovery of 18 liters of country made liquor and 200 Kg of Jawa Mahua and one machine for making wine from the house and field of the petitioner.
Learned counsel for the petitioner submits that the alleged country made liquor and Jawa Mahua has been recovered from dilapidated house of the petitioner and at the time of seizure the said house was not used for residential purposes and only mere on suspicion, the petitioner has been made accused in this case and at the time of recovery petitioner was not present at his house.
Patna High Court Cr.Misc. No.6406 of 2017 (4) dt.03-07-2017 2/2 Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Excise Case No. 04 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
