This application for grant of anticipatory bail arises out of Complaint Case No. 781 of 2010, disclosing offences under Sections 498A of the Indian Penal Code.
The petitioners are indirectly related to the husband of the deceased. Learned counsel for the petitioners submits that they have been implicated merely because they are relatives of the husband of the deceased.
Since this application arises out of a Complaint Case, it is being disposed of with a direction to the petitioners to appear before the court below within four weeks from today. If they do
Patna High Court Cr.Misc. No.38000 of 2014 (5) dt.11-02-2016 2/2 so, their application shall be considered in terms of the decision of this Court in case of Salim Ansari @ Md. Salim Ansari & Ors. Vs. The State of Bihar & Anr. reported in 2015(3) BBCJ V-53 and dispose it of on the same day.
It is indicated here that an interim protection was earlier granted to the petitioners by this Court by an order dated 12.01.2016. If there is no allegation of misuse of privilege so granted to these petitioners, there may not be any impediment in granting the petitioners, regular bail.
