This is the second attempt on behalf of the petitioner for anticipatory bail in connection with Tajpur P.S. Case No.288 of 2020 registered for the offence punishable under sections 304(B)/34 of the Indian Penal Code and under section 3/4 of the Dowry Prohibition Act.

Earlier, the petitioner had filed Criminal Miscellaneous No.20921 of 2022 for grant of anticipatory bail which was dismissed on 26.04.2022.

The petitioner has preferred this application for anticipatory bail after 3 years of its rejection. In view of the judgment of the Hon'ble Supreme Court in the case of G.R. Ananda Babu vs. State of Tamil Nadu & Anr. reported in 2021 SCC OnLine SC 176, second anticipatory bail on behalf of the

Patna High Court CR. MISC. No.62949 of 2025(2) dt.10-10-2025 2/2 petitioner is not maintainable. It is, accordingly, rejected. 5.

In the opinion of this Court, the petitioner is an absconder. She should have surrendered before the Court below after her anticipatory bail was rejected on 26.04.2022 but she has chosen not to do so.

In these circumstances, the petitioner is directed to surrender before the Court below by 31.10.2025. If she does not surrender by 31.10.2025 then the Superintendent of Police, Samastipur will ensure the arrest of the petitioner and her production in the court below so that the trial will conclude. 7.

Let a copy of this order be communicated to the Senior Superintendent of Police, Samastipur forthwith through FAX for its compliance forthwith.
