The present application has been filed for modification of the order dated 8.7.2015 passed in Cr. Misc. No. 29425 of 2015 for extending the period of deposit of 30% of the alleged due amount.

Initially, the petitioner was granted four months time to deposit 30% of the alleged due amount vide order dated 28.4.2015 passed in Cr. Misc. No. 10473 of 2015. The said order was modified vide order dated 8.7.2015 whereby the period of deposit was extended by three weeks.

It is submitted by learned counsel for the petitioner that 30% of the alleged due amount has been deposited but it has been not deposited within three weeks hence the provisional bail was not

Patna High Court Cr.Misc. No.35851 of 2015 (2) dt.19-08-2015 2/2 being confirmed by the learned court below.

In view of the above submissions, the order dated 8.7.2015 passed in Cr. Misc. 29425 of 2015 is modified to the extent that let the learned court below confirm the provisional bail provided the petitioner has deposited 30% of the alleged due amount.

Accordingly, the modification application is disposed of in connection with Sahar P.S. Case No. 6 of 2015 pending in the court of the learned JM Ist Class, Bhojpur. (Dinesh Kumar Singh, J) Anil/- U T
