JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2018 The petitioner is apprehending his arrest in connection with Warishnagar (Mathurapur) P.S. Case No. 178/2016, registered for offences punishable under Sections 302, 307/34 of the Indian Penal Code and 27 of the Arms Act. Allegation as per F.I.R. is that while the informant along with daughter of the Nandosi was coming someone fired, which hit to Pratima Devi and Manju Devi, who succumbed to their injuries. Later on, during investigation, name of the petitioner transpires on confessional statement of the co-accused person. Submission of learned counsel for the petitioner is that except confessional statement, there is nothing against the petitioner and petitioner has no criminal antecedent also. Learned counsel for the State opposed the prayer for bail
Patna High Court Cr.Misc. No.42320 of 2018 (3) dt.07-08-2018 2/2 on the ground that this is a case of double murder. Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender within a period of six weeks from the date of receipt/production of a copy of this order, on which, he is directed to be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with Warishnagar (Mathurapur) P.S. Case No. 178/2016, till submission of charge-sheet and once the chargesheet is submitted and the allegation against the petitioner is found true, petitioner will have to surrender before the concerned and pray for regular bail.
