JUSTICE SANJAY PRIYA ORAL ORDER 01-08-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Nagar P.S. Case No. 61 of 2018 instituted for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged in the written report that informant has got information that his brother had been tied with rope by this petitioner and other accused persons as named in the written report and assaulted him. The informant and his family members reached to the place of occurrence and found his brother lying down tied with rope. The brother of the informant was assaulted by the accused persons with lathi, danda, on account of which, he became unconscious. It is further alleged that Rahul Yadav instigated to kill brother of the informant. Thereafter, Prahlad
Patna High Court Cr.Misc. No.39861 of 2018 (3) dt.01-08-2018 2/2 Yadav shot at him causing injury in the left hand of brother of the informant, but on way to the Hospital, he died. Case diary has been received.
Postmortem report is available in the case diary which shows that brother of the informant had received as many as five injuries on his person. The Doctor has opined the death due to injuries caused by hard and blunt substance as well as firearm. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail.
